1. THE RIGHT TO USE A PICTURE
 
When you order a picture you must tell how you will use it and then stick to that. You may not let others use it. The picture is mine and I decide how it may be used. You are welcome to use my picture once we have agreed on how it will be used and you have paid the price for that use.

2. EXTENDED USE
 
If there is something you need to change compared to the original order, that's probably o.k. but we must first have a talk about it and maybe adjust the price for that use.

3. OWNERSHIP OF PICTURE
 
My pictures are my pictures. You may use them if you pay for it, but they are still my pictures and I own them.

4. NAME OF THE PHOTOGRAPHER
 
If you use my picture, I want to have the credit for it. It's normal to put the photographer's name next to the picture or perhaps with the text that goes with the picture. Some magazines or books have a list of contributors instead. Either is fine.

5. INTEGRITY CLAUSE
 
In some of my pictures there are easily recognizable persons. You may not state or imply that they think or say things that they don't think and/or don't say.
For example, if you use a picture of an indian woman in a wheat field you may not say that she wants to drink Coca Cola and that she hopes India will buy more Bofors guns to shoot at stupid moslems. Most likely, she holds none of these views.
What you may write is that it's indeed an indian woman in traditional dress working in the family's wheat field with simple tools, or that the development of agriculture in India is not yet where most of us would like it to be ... such statements are perfectly o.k.

6. IMAGE REPRODUCTION AND PUBLICATION
 


You may not make any really significant changes to my pictures. If you want to adjust colour and contrast so that the picture will fit perfectly with other pictures, it's probably o.k. But if you are reluctant, ask me first. Do you want to use only half the picture and crop away the left side? That's also o.k. Softed edges are the thing for your publication? Sure thing! Now, what if this picture was black-and-white instead? Oh, yes.
But if you blur the picture and make the colours strange and write that this was the best you could get from www.erichammerin.com ... then we'll meet in court!
If you make a drawing from my picture which is so similar that there's no doubt my picture has been used and then you say you have not used my picture ... then we may also meet in court.
What you do privately for your own pleasure is no doubt your private business, but when you let others enjoy the fruits of my labour, I want to be paid for that. This applies whether you make money from it or not.
If in doubt: ASK!
It costs nothing but it can save us both from unnecessary hassle.

7. DELIVERY OF PICTURES
 
Digital delivery: Over the internet ( if you have broadband ) or CD in accordance with ISO-9660 (normal standard) via mail.
Film images or prints: Via mail. See more below at #10.

8. PRICE AND PAYMENT
 
The market is free and there are no rules or regulations as to what prices should be. Still, it's no fault glancing in different directions and charging decent but moderate prices.
For use within the EU, I glance at the recommendations from BLF ( Bildleverantorernas forening ), i.e. moderate prices. Placement of the picture ( cover ... foldout ... ) and size matters, as does the circulation number of the publication.
All other / non EU customers: contact me!
From a number of countries payment can be made via postgiro or bankgiro. There may also be other forms of payment available.
Credit card payment on-line is planned but not yet available.
Major companies or organisations may have delivery with invoice to be paid within 30 days of receipt.
When your order is filled / delivered, you can no longer cancel it or have a refund. This is applicable also if you do not use the picture.

9. UNAUTHORIZED USE ETC.
 
If you do something with my picture that you have not been allowed, I may feel crossed, p....d off or such. (Read #1 - 6 above.) Then I will charge you at least twice as much as I normally would. If you have done something really ugly I will ask even more and perhaps it has to be settled by attorneys quite unnecessarily.
Ask first instead!

10. BORROWING AN ORIGINAL FILM OR PRINT PICTURE
 
I have very good scanners - both film och flatbed. All my pictures can become digital with very high quality.
If, for some reason, you are not satisfied with getting a digital picture, it could be possible* for you to borrow the original under certain circumstances. Please call or mail me if this is the case.

*Not all pictures can be borrowed but all can be supplied digitally.
